Legal Question in Family Law in Ohio

I have shared parenting agreement with my children's mother. She resides in Ohio and Ireside in Florida. She is listed as the residential parent. The children are currently living with me and I was wondering if there was a time limit on how long they had to live with me for me to be the residential parent. Or do I absolutely have to go to court to change that? They have been here for 2 months and had little to No contact with her. However I am still paying her child support while they are here. She does not want to relinquish custody because of the money she is receiving. What are my options?

In Ohio, the Court's order is enforceable no matter how long the children stay with you until you go to Court to get the order changed. Of course, the longer that the children stay with you and thrive, the better evidence you will have that it is in the children's best interests to be with you. Naturally you will want to keep close track of things like improvements in grades and other social activities so that you can show the court how the kids are doing better with you.
