Legal Question in Family Law in Ohio

Guidelines for Spousal Support in Ohio?

What are the Guidelines for Spousal Support in Ohio? Please point me to a good legal book or web site where I can do some research on this topic.

Can a pre-nup prevent a judge from awarding spousal support above the limits stated in the pre-nup?

Thank you.

Re: Guidelines for Spousal Support in Ohio?

The provisions fo spousal support are contained in Title 31 of the Ohio Revised Code, but there is no set formula. Spouses must support one another to the manner to which they were accustomed during the marriage after a divorce. Prenuptial agreements are enforceable, provided that there is full and fair disclosure, and that they are reasonable under the circumstances. Unless your prospective spouse has her own career, and can support herself without a problem, she is going to be awarded some level of spousal support.

Re: Guidelines for Spousal Support in Ohio?

Ohio Revised Code, Section, 3105.18, governs spousal support in Ohio. Spousal support is based upon need and takes into consideration many factors. You should look at cases like Cherry v. Cherry and those following it.
