Legal Question in Civil Litigation in Ohio

Uninsured driver hit by insured driver.

Recently I was in a car wreck. A young man smashed into my car from behind. Currently the car is my wifes but I am not on her insurance for that particlar car. Does that make a differance when claiming aginst his insurance since the young man who hit me was in the wrong?

Re: Uninsured driver hit by insured driver.

The fact that you were not an insured driver of your wife's car should not make a difference in your claim against the person in the wrong, who hit you. The insurance company will try to use it against you, but the question of insurance or lack thereof on your part is totally irrelevant to the liability of their insured.
