Legal Question in Employment Law in Ohio

FMLA documentation

My actual question was this...if I have a current FMLA form on file and provided a doctor's excuse for an absence, can my employer deny me FMLA and write me up for it?

Re: FMLA documentation

Having a doctors excuse does not necessarily dictate whether the absence is qualified under the FMLA. If the absence was due to a serious health condition, which has a very specific definition in the FMLA, then the employer should not deny you FMLA leave. However, your post does not contain sufficient information about the contents of your certification or the reason for your absence/medical condition to determine whether the employer may have violated the FMLA.
