Legal Question in Personal Injury in Ohio

an accident

I was in a car accident and was not aware of the 2 year statue of limitation until recently. The two year expires after 04-16-2007. Could I file a complaint without an attorney and how can i begin this process.

Have you been talking to an employee of the insurance company that insures the person that caused the accident? Did that peson tell you about the statute of limitations? You need to file the complaint as soon as possible with the clerk of courts of the county which you are going to file. This is generally the county where the accident happened or the county where the defendant (person that caused the accident) lives. Be prepared to pay the filing fee. You should probably call the clerk's office and find out what form of payment they will accept. Some clerks require cash, money order or certified check. The complaint should state where the accident happened, what the defendant did wrong, and what injuries (neck, back, etc.) and damages (medical bills, lost wages, and pain and suffering) you experieced as a direct result of the accident. Also, ask for damages in excess of 25,000. These numbers can be approximate (for example,in excess of $2,000 or whatever you think is the appropriate number). You can amend the complaint later, but it needs to be filed. If you have any questions, feel free to contact me.

You just need to write out a simple statement describing what happened (including when and where), what your injuries are, and how much you're requesting in money damages. If you're requesting more that $25,000, then you need to state that. You really should get a lawyer though. He could always amend the complaint afterwards if necessary. What county are you in?
