Auto Accident Injury Claim

I was seriously injured in an auto accident-Fractured knee cap,broken right arm, three fingers crushed on left hand,and numerous head and ear lacerations. I had surgery to repair the knee,was in the hospital for 3 weeks, and rehab. for three months. the knee and hand are repaired,but still don't always work correctly, and are painful sometimes.The other driver has admitted fault,and her insurance is going to pay,however, she has a $100,00 limit, and that includes the medical bills. They are going to offer the $100,000.But we have to pay the medical bills out of that.Do we have any other recourse?

What you should do depends on how wealthy the person who caused the accident is. You can win a judgment for more than $100,000 but if insurance only covers the first $100K then you have to look to the Defendant for the rest. If the defendant is collectable then your in luck. If the Defendant has assets and a good job you may want to consider going after more money through a lawsuit.
