Legal Question in Personal Injury in Ohio

Statute of Limitation???

In 2003, I was involved in an automotive accident where a pedestrian was struck. When he filed suite in 2005, just in time before his statute of limition ran up, the case was dismissed because he did not turn in medical documentation requested by the defense attorney. Now he is trying to file a civil suit again. Is this permissable?

If a complaint is filed and dismissed "without predjudice" or "otherwise than on the merits", Ohio Law allows a person to refile the complaint within one year of the date of dismissal. The complaint would not be barred by the statute of limitations.
