How long after closing on a home does the buyer have to sue the seller for failure to disclose information?The owners did not disclose water in the basement, and because the the water was coming from an inaccessible (panelled wall) area, the inspector was unable to find the cause ''moisture'' in the basement. We have dated photos and their signatures on the disclosure that there was no water in the basement.

You have two years from the date that you discovered the problem. Even if it has been longer than that, you may still have a claim.

How do you know that they knew about the water?

That is the biggest problem in a case like this.

They should have known, but how do you prove it?
