Sexual Harassment In A Nursing Home

I work in a nursing home with 50 ''residents''. I am a nurses aide. One man,who is in his right mind, always makes lewd comments and gestures towards the aides. He has even went to the point of grabbing some of us in places that are not appropriate. We have asked him to stop. He doesn't. We have went to our employer many times about this resident. Nothing has been done. We are told ''If you don't like, find another job''. What are our rights? We are always told of the ''residents'' rights and things we can't say or do, but never of our rights. Can you tell me if there is anything I can do legally?

In Ohio, employers have a duty to protect their employees from sexual harassment by not only employees but others who frequent the business location. If your employer has a policy on sexual harassment and reporting it, you should be sure to follow it. But apparently the employer is not being responsive to your complaints.

If you cannot get the employer to take action and you need assistance, you have several different options available to you. Some of them include: (1) Hire an attorney to assert your rights to be protected from sexual harassment and offensive touching; (2) File a complaint with the appropriate governmental agency that exists to enforce the laws against harassment. These agencies include the Ohio Civil Rights Commission and the Equal Employment Opportunity Commission; (3) File a complaint with the agencies responsible for enforcing workplace saftey laws. These agencies include Ohio's Occupational Saftey and Health Administration, and The United States Department of Labor's Occupational Saftey and Health Administration.
