Legal Question in Traffic Law in Ohio

truck accident with no injuries

My husband and I own our own business and we travel to fairs and festivals in the United States. Recently my husband was on his way to a fair out in Pennsylvania driving a dually pickup pulling our trailer which houses our business and was involved in an accident with a semi truck. He was on the turnpike, in the right hand lane and was being passed by the semi when the semi then lost control and hit our truck in the drivers door and also side swiped our trailer. When the driver approached my husband and the police officer he stated that he was having steering problems with his rig. Needless to say, due to the damage to the truck and trailer, he was not able to do the fair in pennsylvania. The officer did say that the truck driver was cited. He has gotten the equipment back home to Michigan and our insurance is covering the cost of our truck but informed us that it is our responsibility to go after them for the cost of the repairs on the trailer. Now here are our questions:We are currently out of business until these repairs are done, so do we have the right to ask for the cost of the repairs and the lost income. Also is it advisable to get a lawyer before contacting them or can we handle this ourselves?

Ultimately, if the insurance company is not willing to provide for all your losses, you need to sue them. Keep all your receipts, be diligent in writing down all your losses. A jury will ultimately determine what you deserve.

You need a lawyer. Don't sign anything until you hire one.
