Legal Question in Wills and Trusts in Ohio

My son is 14. His father died without a will. The day after he died, he received a check in the mail. The check was $1200 for a VA pension, which covered the previous month. Another relative, my son's grandfather, took the check and deposited it into grandfather's own account. Is my son entitled to that money? He is my ex's only child, and my ex had no spouse. We live in Ohio.

If your son is your ex's only child and your ex had no spouse then your son is your husband's heir and is entitled to all probate assets of the estate. If the grandfather paid for your ex's funeral it is possible he might be able to apply to the court for funds up to $5,000.00 as reimbursement for the funeral expenses.
