Legal Question in Wills and Trusts in Ohio

Trouble with stepchildren

My husband died recently. I had a signed blank check he had given me. I dated it 14 days before he died and deposited the check in my account the day after he died. His adult children from a previous marriage are threatening to take me to court for a felony because they say I took money from his estate. He left me the house (survivorship deed) and our joint checking account (we had a preneptual agreement)his children get everything else. There is plenty of money left for them to divide. He never even put me on his pension; so I have no hospitalization or medical benefits. I am 62 years old and work part time as a cashier for $7.15 per hour. Can I be charged with a felony? Do you think I will be allowed to keep the money? Thank you.

Re: Trouble with stepchildren

You will probably not be cahrged with anything because the the checking account was joint with you being the other party. Therefore, the money was yours in the first place. There must have been other assets available for the kids to get.

Good Luck!!!
