Time Limits for Collection?

My daughter had braces 3 years ago. I ended up in divorce, and the ex was ordered to pay the bill. He did not. I could no longer pay because of being left with 4 children. Now 3 years later the DDS is hounding me for the full payment with interest included. I know that I am responsible for 23% of the old bill due to instructions set forth on the decree of divorce, but after 3 years can they still sue me and garnish my wages as threatened?

If you are in Oklahoma, the statute of limitations is probably 5 years for this type of action. Therefore, the DDS is within the time to bring legal action against you. Your remedy is in the divorce case. You will have a cause of action against your ex for the part of the medical bill he was ordered to pay. If the DDS does sue you and obtain a judgment, he can garnish your wages, but only if, he obtains a judgment.
