Do I have to use claim money as intended?

I recently received claim money from my insurance company to repair a porch roof. Well, my home is also currently for sale. Yesterday, a buyer presented me with an offer lower than my asking price, but said that he doesn't want me to repair the roof, so I can keep the money (bringing me back up to my asking price). Can I keep the insurance check? When I filed, I had the intention of fixing the roof, as I was not planning to sell at that time. Please advise.

Often the insurer will make the check payable to you AND the company doing the repairs. If that's not the case and you decide to keep the check, you should make sure the home buyer is aware and agrees, in writing, of the roof issue.
