Legal Question in Medical Malpractice in Oklahoma

knee surgery

my boyfriend recently had surgery on his knee.(acl reconstruction) About 7 days later the doctor removed his staples then about 2 or 3 days after that the place where the staples was came open. he had to go back to the hospital to get it reclosed. the doctors office charged him another co-pay which was $250. since it was their mistake that caused this should they have made us pay again?

You don't say if he has health insurance, but you call the charge a copay which is associated with insurance. Assuming he has insurance it is unlikely you should have had to pay because insurance usually pays one fee for a surgery and the follow ups come with it. You should ask them first why they charged for a follow up, and second why they charged for something that appears to be their error. If they won't refund you, ask for their reason and policy in writing. You may also want to ask for a complete copy of the medical chart.
