Legal Question in Traffic Law in Oklahoma

2 Party Auto Accident

My son was pulling out of the parking lot of his employer,making a right turn onto a two lane road approx.50 feet past a stop signal. After observing there wasnt anyone approaching and light turned yellow,he proceeded to pull out and was struck in the drivers side rear quarter panel.The driver of the other car was issued a ticket for running a red light,my son was issued a ticket for driving under suspension. Their insurance is stating they shouldnt have to pay because he was coming out of a private drive and didnt yield. My son has subsequently incurred physical damages not to mention his car being totalled in the process. At last meeting it was explained to my son that they werent going to pay for him another vehicle because they felt it was equal blame and if they wanted to they could drag this out for up to 9 months. My question or questions are is this legal since she got the ticket? And dont they have to reimburse my son for all the expenses such as medical and transportation?

Not uncommon for insurance company to attempt to get each party to use his/her insurance to settle claim. How has your insurance company evaluated fault? Where was your accident? I suggest that you contact an attorney before too much time passes. Generally, once fault is established, insurance works to pay damages to car, medical bills, lost wages and sometimes pain and suffering depending on the type of injury.
