Legal Question in Medical Leave in Oregon

Difficult Pregnancy

I am nine weeks pregnant and am extremely ill for most of the day every day. I still have 30-some weeks to go! My question is two-fold: Will FMLA cover first my difficult pregnany (should this continue) and then birthing/parenthood as two separate leaves? If this continues, do I have coverage under long-term disability?

Under the federal law, each condition can qualify for FMLA leave. However, you are entitled to only 12 weeks of protected leave during a 12 month period. This means that you are not entitled to a 12 week leave for the pregnancy complications and then another 12 week period for the birth of a child.

State law may provide greater protection and you should consult with an attorney in your state to determine what rights you may have.
