Legal Question in Employment Law in Oregon

non payment of wages

I have not been paid for two weeks as of tomorrow.I'm working

for a contractor putting up sheetrock, the contactor keeps giving me excuses. He has given me an excuse every day since

saying he will pay me tomorrow then giving $15.00 for food and bus fare. He is paying us under the table(no taxes or deductions)I am sure that this will make things more difficult, but need to know if I have any recourse.

Re: non payment of wages

Oregon law permits you to bring suit to recover your unpaid wages. In any such action, you can recover attorneys fees from the defendant-employer as well -- at least so long as a written demand is given before filing suit. In addition, when no wages are paid for a period of time, your right to receive at least minimum wages also has been violated, so your suit would include a minimum wage claim as well. You should seek the advice of a lawyer or contact the Wage & Hour division of the Oregon Bureau of Labor.

The above does not constitute legal opinion and is offered for the

purposes of discussion only. The law differs in every jurisdiction, and

you should not rely on any opinion except that of an attorney you have

retained, who has a professional duty to advise you after being fully informed of all the pertinent facts and who is familiar with the applicable law.
