Legal Question in Family Law in Pakistan

my wife has applied for khullah for last 3 moths and we are living separately for 8 moths. i tried to talk to her through relatives & myself but her parents did not allow me 2 talk.Her mother has instigated her to this level that you cannot live with her.she want her to get married somewhere else for unknown reasons.

Can i talk to my wife in private in court.If she comes in court she may say that i donot want talk to talk to my husband as her mother already brain washed her and fed this thing that u donot have to tak to him.Can court pressurize her to talk in private.

Thanks for your mail , yes there is a provision of patch-up before trial and even family court/judge will encourage this provision/reconciliation , and its your fundamental right accede in constitution of pakistan 1973 .

secondly she has to prove strong grounds for khulla , if you are earning enough,providing butter and bread ,if you are not impotent, if you are not beeting your wife, if you are bearing good moral character,and you have phisical and mental sound health then they need to prove or bring very strong grounds to prove that this marriage should be break.

well its your right to talk about reconciliation and court will provide you enough time to reconcile.

You can request the court to allow her to talk to u in absence of her relatives. Usually the good judges take the spouses to their chambers and try to reconcile between them. It is strange but fact that most marriages end up because of too much involvement of in laws between the affairs of spouses. Your case seems to be the one.

You can also file a case for the restitution of conjugal rights seperately. That mean your wife must be ordered to live with you. However if there are much differences between you 2 then there is no force that can pressurize you to continue the relationship. For more you can always consult me free at [email protected]
