Legal Question in Administrative Law in Pennsylvania

Sentencing sheet errors by courtroom clerk

If you are sentenced to immediate work release by a judge and the court clerk writes up your sentence sheet to immediately eligible for work release and this delay causes you to lose 20yrs of a vested career and any retirement benefits or lose of any investment monies,do you have a legal lawsuit against that county to recoop those losses and any future earnings that you could have earned? ie: social security,401K investments, pension, raises etc. ?

if you have court transcripts to back up that claim and a letter of admission that an error was made does a person have a legit case ?

Re: Sentencing sheet errors by courtroom clerk

You asked about a court clerk error.

Unfortunately your potential for a claim does not look good against the official. There is a statutory immunity for damages caused in the line of duty for public officials.

Generally states and their actors are immune from suit to a certain extent. There are many situations where immunity is waived or limited and this would be discovered on further investigation by an attorney.

This is not a definitive answer and the matter should be brought to an attorney immediately. You just shouldn't get your hope up about a recovery.

Roger
