Contractor Error

I contracted for a deck to built and when it was completed it was not what I contracted for. The deck had steps placed when it should have been flush with my sliding doors. I have nosigned contract with this builder, I do have plans that show what we wanted. Verbally one of the contractors workers admitted the mistake. He wants to take me to court since I have not paid any monies. I havew spoken with the contractor and gave him the option of tearing it down and doing it right or excepting half the money for the project is restitution. Does he have a case?

Re: Contractor Error

Even though there was not a written contract, this would be handled as a contract dispute based on your oral agreement. If the court finds that the contractor made a mistake, it might reduce the amount that owe by the severity of the contractor's error, possibly even 100% if the deck has to be completely replaced.
