Can a driver for an escort service be arrested if he has the client sign a contract not to touch or do anything sexual?

The short answer to your question is yes one can be arrested. The question is whether they can convict. The state would need to prove Intent to commit a crime or in your case whether you had knowledge or should have known a crime would be committed.

Yes. Not only can he be arrested, he can also be convicted if the prosecutor can prove beyond a reasonable doubt that he knew that the escorts were committing prostitution. The contract would be relevant evidence, but a jury could believe that the contract was a sham and that the driver was well aware of what was going on.
