retail theft

i have a background of an ard i was on that program in 2003. i got retail theft in 2004 and now one recently is it likely to get jail time for this the retail theft amount is only 22 dollars. what do u think?

There's not enough here to answer conclusively. You won't get ARD this time but if the ARD probation period was served before this offense was committed, you don't have to worry about re-sentencing. Since you are apparently not in jail right now, I think it is likely that you do not have to worry about a probation violation and that you served the 2004 ARD conditions. As to whether or not you are looking at jail time, only an attorney that practices in your County will be able to give you some idea of what king of time you are looking at, if any.
