Can I take thieves to court without taking a 3rd party

On 4/17/08 my cousin's broke into my house and stole 2 game consoles and about 20 games. My neighbor saw his truck at my property while I was not home. I have the serial and original boxes for both consoles. I finally tracked down the person they sold it to but have no interest in taking him to court. I want to take both of my cousins and have them buy me a new system. The guy that bought the systems said he will testify as long as he won't get in any trouble at all. Can I take my cousins to court without taking the buyer since I have my neighbor and the buyer to testify on my behalf.

You can file a civil lawsuit against your cousins in small claims court alleging theft without suing the individual who purchased the goods.
