Legal Question in DUI Law in Pennsylvania

My son was taken for a blood alcohol, possibly drug testing as well last night. Can he be cited in PA for DUI if he was only walking in an area with a friend, that was not in the same area as where he car was parked? Apparently his breathalyzer was .09, limit in PA is .08

Found out this morning that reason he was even approached was that about 30 minutes earlier he brushed a fence with the front of his car leaving a pizza place, before going to a hangout spot in the woods where he drank a couple of beers.

We are financially distressed, and he had a DUI 2 years ago, was in the ARD program.
