power of attorney

How does an only child attain power of attorney, for mother when she became incompetent in the hospital. All accounts, and property are in mothers name only.

Once an individual lacks the capacity (i.e. not competent)to make decisions regarding their finances and person, that person may not execute a valid Power of Attorney. Your option is to petition the court to become the plenary guardian of the estate and person. You need an attorney to assist you with this. Good luck.
