Legal Question in Family Law in Pennsylvania

My brother has been seperated for three yrs. He has now become I'll (im making/handling medical decisions/speaking to drs and taking him to appts) she won't get a divorce in hopes to cash in on him. He cannot afford a attorney, how long to you have o be seperated in order for her not to claim anything, or he can diverce her without her?I live in pa, she is in nj.

If your facts are correct, he does not need her permission to get a divorce. He likely needs a lawyer.

I concur with the the other attorney. Your brother would be wise to meet with an attorney to discuss any related economic issues that may be involved but the bottom line is that with a separation of over two years he may proceed under 3301(d0 of the divorce code two year separation.
