child custody/legal guardianship

My sister may be going to jail and she wants me to care for her kids if she does. Does she have to go through a lawyer to give me legal custody of them, or can she just write up a paper herself and have it notarized?

The jail should have the paperwork. At least they did at the county prison.

That said if dad is in the picture he could go to court and try to get custody.
