Child Visitation

My 12 year old child doesnt want overnight visitation with her father. He is constantly criticizing and belittling her, and has no interest in her personal accomplishments. He works every weekend, and she sees him very little when she is there. Can she refuse overnight visitations?

If there is a court order, a child cannot supersede the Order. You could be subject to father's filing a petition for contempt. Your best option would be to file a Petition to Modify the Court, and the child can speak to the Master or Judge as to her preference for a visitation arrangement, if any.
