common-law & divorce?

If you & your partner once lived together as common-law and now you have been seperated for 11 years, is it necessary for a divorce in order for one of them to marry someone else?

There are many factors. However, if two people just lived together , there is no need to divorce the other person. Under the eyes of the law a divorce is required only if there is a legally binding marriage. Unless there are facts that could alter my opinion, I say go ahead and marry. Forget the necessity of a divorce. You may want to review the entire set of circumstances with a lawyer.
