Legal Question in Family Law in Pennsylvania

My daughter will be 11 in June. My daughter's father went to jail when she was 2yrs old for 61/2 years and was released when she was 9. He was out of jail for 10 month and was arrested again. He has been in jail for the past 10 months. He calls to talk to her but she does not want to speak to him. Am I able to have his rights as a parent terminated? He has spent 8and 1/2 years out of the 11 years she has been alive in jail.

No the state will not make you child an orphan. The only way to have his rights terminated is for the child to be adopted. This is done by having your new husband adopt the child and you would adopt your child as well. Otherwise we would have to see if the reason he was in jail was for violating an enumerated.offense. That might limit his contact otherwis you have a duty to foster a relationship with dad.
