Legal Question in Family Law in Pennsylvania

estranged husband not the father

My estranged husband is not the father of my baby. We were unmarried when I became pregnant. My boyfriend was not interested in the baby. My long time friend married me. He turned out to be another jerk (abusive and so forth) and has since left.

We are not together nor can I or will I speak to him for safety. Will I be forced to name him on the birth certificate even though we no longer have an intact marriage.

No you don't have to name him on the birth certificate especially if you know that he is not the child's father. There is a presumption PA that a child born to the marriage is the product of the marriage but there is no reason to name him in light of the circumstances.

If I can be of assistance, please do not hesitate to contact me.
