Legal Question in Family Law in Pennsylvania

My ex husband is trying to claim our son on his federal 2012 taxes. We have no custody agreement and he has had no contact with him for almost two years now. Is this legal?

Usually the parent who has custody can claim in the absent o an agreement to the contrary......but I would call a tax advisor--whoever does your returns...
