Legal Question in Civil Litigation in Pennsylvania

My daughter was caught with 3 cigarettes in her possession upon entering the school. She handed them over immediately. Now she is being charged with "use of tobacco...." and we have to appear before the judge. She was not using tobacco, she was in possession of tobacco. Is there a difference?
