Legal Question in Civil Litigation in Pennsylvania

how to get a disclosure

I am in a civil suit when we went to the magistrate the plaintiff said I owed him $10,000 dollars but when we went to the first investigation the officer said the plaintiff said $2500 dollars. How do I get a copy of all the items he said I owe for?

Re: how to get a disclosure

The limit that the magistrate can award is $8000 plus the filing costs.

As a rule Magistrates don't make transcripts of their hearings. So there is no record to get.

If he presented any documentation of the claim to the court you should have gotten a copy. If you didn't its unlikely the Magistrate kept a copy at least one I dealt with informed the litigants that if they did not come an ask for any of the submissions that he wasn't going to keep them for more than 5 days.

If the case went against you you have 30 days to appeal the the Common Pleas court. If you do that then as part of his plea he would either have to include them in his complaint or produce them via discovery.

If you have any questions feel free to contact me. The initial consultation is free.
