Ex-girlfriend breaking verbal contract

I gave my now ex-girlfriend a promise ring on Christmas day. It was not considered a gift nor did I tell her it was. I told her that it was a promise ring and she agreed and put it on her finger. 3 hours after giving her the ring, I find naked pictures of a guy on her phone that I pay for and her sending text messages back about meeting to engage in sexual activity. I broke up with her for this reason and asked for the ring that I gave as a promise that she broke the agreement and my cell phone back. I have not yet got any of the items back and she refuses to give them back because she says the ring is a gift. What rights do I have to get the ring back? I am making monthly payments on the ring and will not be paid off for 6 months. Is there anythings I can do to get it back? Should I take it to small claims court? Any help would be greatly appreciated.

How much did the ring cost? If it's under $2500.00 write it off as a learning experience, as for the cell phone, it's worthless, just terminate the contract with whatever carrier you are listed with, a termination fee of approximately $150.00 will be charged to you...at least then you won't be paying for her adultery...one last thing guy...NEVER...NEVER...give any gift such as an engagement ring or promise ring on a holiday, let alone Christmas, Valentine's Day, or her Birthday....you will be hard pressed to win this case.

Just walk away from this girl, and be thankful you were not married to her. Finally learn from this lesson and you'll be ok...best of luck.

You may or may not get the ring back. Giving it on Christmas and all. You should get the cell phone back. If I were you I'd take it to small claims court. Unless, you left something out of the facts stated the most you would have to lose is the filing fee which if you win you could ask the court to make her pay for. Good luck.
