A deposition is when an attorney asks oral questions of a witness who is sworn to tell the truth. A stenographer is present to write down everything that is said. It usually takes place in a lawyer's office.

There are also depositions taken of expert witnesses such as doctors in workers' compensation, personal injury, medical malpractice, and disability cases. Sometimes it is difficult for clients in workers' compensation cases to understand why they have to take a doctor's deposition rather than just submit a report and the answer is that the insurance company's lawyer has the right to cross-examine the doctor.
