Can I sue the SPCA if their employee was negligent and my kitten died?

You asked about suing the SPCA.

If you ask me, you're barking up the wrong tree.

I couldn't resist that one. In most cases the SPCA will be considered as performing a government function and as such would be immune unless the agents willfully violated your civil rights or a clear law. Also, damages would be next to nothing as domesticated animals are subject only to chattel value. Essentially, what it would cost to replace the beast.
