Legal Question in Insurance Law in Pennsylvania

Work truck accident, not at fault

I live in PA. My work van was hit. The other driver admitted fault. His ins. co. offer is not enough to repair the damage nor buy another vehicle. I feel that I should be restored to pre-accident status. They are refusing to alter their offer. The vehicle is older but has a new engine w/only 40,000 miles on it.

Shouldn't I be restored to my pre-accident status? The accident was not my fault but I have lost work time, spent hours on the phone, etc. due to someone elses carelessness. I feel that I should be compensated to either repair my work van or purchase another with similar mileage. This insurance co. is refusing.

What recourse do I have?

Thank you
