Legal Question in Employment Law in Pennsylvania

Can they fire my wife?

My wife is in the hospital with pneumonia, this is the third time in just a few months,The last times she was addmitted to the Hospital her Employer wrote her up,and even put her on 6 months probation, they envoronment is cubical based and i believe the air system is recurculation and anyone sick is speading germs through out the building,so the main Question is can they fire her for missing work because she has health problems?,she's presently a patient and I would like to ease her mind on this matter so she can focus on getting well as opposed to worring about lossing her job.

Re: Can they fire my wife?

The Family Medical Leave Act (FMLA) sets out strict guidelines regarding how employers must treat employees who need time to care for themselves or family members.

A number of questions must be asked. Has the person used up all of the company granted sick time? How much time has the employee missed from work? Has the employee informed the employer that the employee is in need of FMLA leave (up to 12 weeks in 12 months)? Has there been any retaliation?

As to the possibility that the air is making her sick that could or could not be a separate issue. If this is the case there are avenues to depending on the specific circumstances.
