personell agencies employment contracts

I used an employement agency to help me find a job. I recieved and offer and accepted the offer was a full time job, direct with the company not the agency I accepted the offer on Friday April 12, 2002. The acceptance was done over the phone. On Monday Arpil 15, 2002 I called both parties and I withdrew my acceptance to the offer. The recruiter told me that I could not decline now because I had already accepted the offer. I recieved a letter of intent for the forementioned company 2002 which I did not sign. I made a verbal commitment, but then withdrew. I did sign there contract stating that ''If I reach and agreement with the employer about a starting date, starting salary, and job duties, and if I fail to report for work or you voluntarily resign within 10 weeks after starting work to accept employment elsewhere, you will be responsible for and agree to pay the personell company the fee.'' I was under the impression that with all contracts that I had a 3 day cool off period, which I properly excersized!!! I am now being sued by the personelle agency stating that I am in breach of contract. Please advice me of my rights. Thanks

To a large extent, your case is going to be determined by the language in the agreement itself, (i.e. the fine print) and the circumstances under which the agreement you refer to was signed. Without actually seeing the agreement, however, it is not possible to accurately assess your situation.
