Unused vacation

My husband has put in his 2 weeks notice to his present employer, he has 40 hours vacation that he has not used, do they have to pay him for that unused vacation, when he leaves?

You asked about pay for unused vacation.

Vacation pay is accrued and earned as per the employment agreement or employer policies. In all cases vacation pay must be paid out upon termination. In many cases an employer will accept a termination and then escort an employee off the property. The vacation pay is used to pay out any notice period and then any excess vacation pay is forwarded in a check.
