One-week late on rent/being sued

I gave my landlord 30-days' notice that I will be moving and will be out on July 15, 2008. I am only one week late on this months' rent (I have never been late before) and he served me with court papers just for being one week late. Legally, can he do this, and what is my recourse? I have already told him that I will pay the rent this weekend, so it is only a week and a half late at that point and will be paid in full before I move.

He can do it but if he didn't give you a notice to quit he may lose his case. Unless its stated otherwise in the lease he has to give you a notice to quit at least 10 days before filing paper at the DJ. If he doesn't then the DJ has no jurisdiction to hear the case and the landlord loses. If he loses he pays the filing costs.
