Legal Question in Medical Malpractice in Pennsylvania

medical malpractice

3yrs ago i had a plate put in my head from a bad fall. i was released 24hrs later with just tylenol 3.10 days later iwas back in for surgery from a staph infection i had no idea about. it rotted part of my skull,which i am now missing. what is the statue of limitations in PA

The Statute of Limitations in PA is 2 years from the date of injury.

There is a �discovery rule� under which the time is extended if you were unable to know of the injury.

This rule may apply in your case.

Generally, the statute is two years, which would appear to preclude your claim.

Nonetheless, you may want to contact an attorney anyway to see if your claim falls within an exception like the "discovery rule," which keeps the statute at bay until you discover (or should have reasonably discovered) the negligence.
