Legal Question in Medical Malpractice in Pennsylvania

had a tumor removed from my pancreas at hospital. There were some issues with pain management immediately postoperatively. They could not wake me up, my stats dropped, nail beds were blue. They say I may have been given too much pain medication(morphine) from the anesthesia which needed to be reversed with narcan. Since narcan reverses the morphine I was in terriable pain for a number of hours following the surgery until they could safely give me something for pain management. Had they not reversed the morphine, I would have died from an overdose. This happened in April, 2007. Do I have a case? Hospital, anesthesiaologist?

I don�t see a case that I would take. As I see it, the doctors aggressively tried to manage your pain, (arguably TOO aggressively). They recognized when they couldn�t wake you and reversed with narcan. In my opinion, this met the standard of care. Another attorney may have a different opinion, so I encourage you to inquire further if you believe you may have a case.

You suffered a number of hours of terrible pain. You report no permanent damages.

Another attorney may view this as an overdose case, depending on the amount of morphine given and may find damages that justify pursuing this case. For that reason, so I encourage you to inquire further of you are interested in pursuing this case.
