Legal Question in Personal Injury in Pennsylvania

AutoAccident@Work,FaultyCompanyVan

I was injured in an auto accident while returning back to work from a service call I had at another company owned office. The vehicle I was driving had faulty rear brakes (Proven during investigation). Other employees who drove the van also noticed the brakes were not right and notified the company as I had also done. The Company had done nothing about it since the co-worker in charge of the Van failed to inform any supervisors of the reports about the van. As a result of this co-workers negligence, the Van was never taken for repair. As a result of the accident, I was off work for over 6 months to rehabilitate from a Left Broken Hip, Multiple fractures on Right forearm including compoud fracture, Severed tendons on left hand, and torn ligament in left knee. My questions are: Can the company I work for be liable for the accident since they knew about the brakes before the accident? I own a part time Computer Consulting/Repair Business and have lost revenue as a result of this accident. Can my business sue the Company for lost Revenue? The accident happened in 07/1998. Any help or suggesstions regarding what I can do would be much appreciated.

Re: AutoAccident@Work,FaultyCompanyVan

PA gives employers very strong immunity against lawsuits. It's not likely there's any way the company would have to pay anything other than workers' comp benefits.

However, you certainly have very serious injuries. You absolutely should consult an attorney in your area to make sure any possibility of a third-party claim is investigated. You have two years from the accident date to sue, but almost a year has been lost already. Feel free to call or respond to the address below.

My firm handles many cases of work injuries where we try to find ways to get additional compensation for injured workers, and there's no charge or obligation for a consultation.
