Legal Question in Personal Injury in Pennsylvania

injury

I fell outside a restaurant chain and broke my ulna and radius. The lack

of use of my arm has hindered my doing my job ( self employed) and

forced me to purchase speaking software and hire drivers, etc. Should I seek compensation for my injury. The restaurant took my name, address and phone number but has not contacted me.

You should consult with an attorney to review the facts of how the injury occurred. Insurance may be available from the restaurant to pay your medicals. Cases such as these are fact sensitive. That is why it is a good idea to have an attorney involved and to put them on notice of a possible claim and that will make them refer it to their insurance carrier. Very often, restaurant insurance has a medical payment provision, which pays for medical expenses of injured patrons even when the restaurant is not at fault. If you have insurance co-pays, no medical insurance, or limitations on your medical insurance, then you should certainly investigate the restaurant's policy.

Whether or not to seek compensation for your pain and suffering is a slightly more complex question. The main issue is: What caused you to fall? Was there a defect in the sidewalk, or had someone splashed water on the sidewalk, for instance. If, on the other hand, you simply tripped over your own feet (as often happens) then unfortunately, there likely isn't anything that can be done.

Finally - the wage loss claim. Some insurance policies carry wage loss provisions the same way they carry medical payment provisions, but this is rare. Again, I recommend investigating their policy. And, if you fell due to a reason that was not your fault, then this is a reason to file a claim for compensation.

Whether or not you could succesfully make a claim for your injuries, medical bills, wage loss, and out-of-pocket expenses will depend on why you fell, whether the restaurant did anything negligent, and whether your conduct was negligent.
