Legal Question in Personal Injury in Pennsylvania

I was recently involved in a car accident in which my car was totaled and I was injured with a sternum contusion. The other driver is totally at fault and his insurance company is accepting complete fault, but our car is not paid off and I am unsure if any settlement will cover what we owe plus a downpayment on a new car. I am also unable to drive now because of my anxiety and can only be in a car in very short distances. Everyone tells me that I should hire and attorney but I dont know if I really have a case and what is the next step. Please guide me in the right direction

The money you get for your car will be the "book value", as calculated by law. Most people do not get enough to pay off their old car and make a down payment on a new one.

You should absolutely talk to an attorney right away. I know that you probably don't want to be "involved" in a lawsuit, but you'd be amazed how little you need to be involved in the actual case. Once you sign up with an attorney, they will handle your case on a contingent fee (no fee unless you recover) and prosecute the case, while you focus on HEALING. Also, time is of the essence here, because the insurance company would like to process your claim without an attorney so that they can determine how much they want to pay you. You should speak to an attorney as soon as possible. From the facts as you relate if the other driver is at fault you may have a case. There is much more that needs to be determined such as the extent of your injuries your totr selection in your automobile policy and many other factors. Your inclination to hire an attorney may be right, but I can't tell you a lawyer is always absolutely necessary in accident cases. Depending on the situation, you may be able to bargain a settlement direct with the insurance company and save the legal fee. However, most people are uncomfortable doing this and choose to hire a lawyer because the lawyer usually gets a much better settlement from the insurance company.

First off, you may be absolutely right about the car being totalled and there being a "gap" between the insurance settlement and the remaining balance on the car note. Some people have "gap insurance" to cover that very situation...someone needs to check your policy to see what is covered and what isn't.

Similarly, some people have "limited tort", meaning that they can't be compensated for personal injury that is deemed to be "minor". You need to determine your policy election to see if you chose "full tort", which allows you to go after money for any type of injury, or limited tort.

you should look for an attorney in your area that has experience handling motor vehicle cases. You should not go this alone. Insurance companies are in the business of saving money not spending money and you will not get a fair deal without competent advise.
