Personal Injury Settlement

I was involved in a motor vehicle accident in Oct. 93 which was not my fault. I've had numerous surgeries which included 2 bone fusions in my neck with a plate put in the front of my neck and cables in the back of my neck, all cervical injuries. My medical bills amount to approximately $80,000 and am currently negotiating a settlement. I would like to ask your advise as to what amount I should conceivably ask for to begin negotiations.

I trust you mean October *98* (not 93) or the case already is in suit. If you have a lawyer, consult with him or her. If not, it usually is penny-wise and pound-foolish to try to avoid an attorney's fee and negotiate your own settlement. The insurance adjuster is very experienced at negotiating. Shouldn't you have an experienced person on your side (who also credibly can threaten a lawsuit if a fair settlement isn't reached)?

This is something you and your attorney should discuss WITHOUT advice from persons knowing nothing about your circumstances.

No competent attorney can answer this question without knowing your case inside and out.

Given your date of accident, I assume the case is in suit and you are represented. The value of a case has many elements which you have not provided but which I am sure your attorney knows, i.e., the amount of insurance, the availablity of underinsurance coverage, etc. I hate to put it this way but either you trust your attorney or you don't. Discuss his/her settlement strategy and the above issues with him/her.
