Buying / Selling Contract

I entered into a signed contract agreement with a seller of a home that was listed on the market through a realator, to buy the home. All the nessessary legal binding contacts where signed by myself, the seller, and the realtor. The closing on this home is scheduled to take place 08/29/2003. In the mean time, I have sold my home, and the closing on my home is scheduled for 08/25/2003. My children were registered into the new school district, and all other pertinent arraignments were made for me to move.

I gave the people whom I'am buying the home from $1500 dollars hand money. Now I have found out, the seller does not want to move or sell this home. My questions is, what is my legal recourse on this breech of contract.

I have sold my home, so I have to move out, and I need a place to go.

You can force the seller to sell the home to you and collect damages for his breach. You must sell your home. I suggest you contact a lawyer immediately to insure your rights are protected. Real Estate - A party (Buyer or Seller) refusing to close

When the parties have signed contracts, (agreements of sale) and refuse to close they may be in breach of the contract. A lawyer should be consulted and the contracts reviewed to discuss your legal rights and your obligations. In general you may be able to sue for �Specific Performance� (to force the sale of the home) and/or sue for damages.
